Commercial Litigation
Commercial litigation encompasses a broad range of civil litigation to include suits on instruments, foreclosures, landlord/tenant evictions, title curative actions, defensive litigation, and all other business and consumer actions filed in Federal and State courts. The emphasis is on quickly prevailing in the dispute through litigation and any available non-litigation resolution to include demand prior to suit, aggressive negotiation, and when appropriate, mediation, or arbitration.
Mortgage Default
The firm represents mortgage bankers, servicers, vendors, loan companies and others who own, manage, and service real estate loans. The firm has a proven track record of loss mitigation when possible. There is careful attention to the lender/borrower relationship with the hope that the relationship can be repaired short of actual loss of the property at foreclosure sale. Foreclosures are not handled in a routine or assembly line manner. Rather, each case and each client is given attention. If loss mitigation is not possible, the case is resolved quickly through judicial sale and delivery of good title.
Collections
Our strong collections practice is built on a keen understanding of compliance under the Fair Debt Collection Practices Act and other Federal and State regulations. Replevins & Repossessions
We have a proven track record of understanding our client’s needs in the area of replevins and repossessions. Our approach is to foster good communications with our client’s customer. We first attempt to save the loan through loss mitigation, then move to efficiently resolve the delinquency through suit and advise on all aspects of the repossession.
Bankruptcy
Creditor representation in bankruptcy is a dynamic area. A bankruptcy filing is never good news but through adept representation there can be a recovery and loss can be minimized. All of our attorneys are trained in bankruptcy law and we are admitted to all of the Bankruptcy Courts in Florida. Focused on creditors’ rights, we do not represent debtors.
Real Estate
The firm conducts title insurance litigation, title curative litigation and resolution, real estate litigation, and real estate closings through Buyers’ Title. We address code violations, tax liability, zoning issues and other matters that affect marketability.
